MEMPHIS, Tenn. – FIRST ON FOX: Memphis shooting suspect Ezekiel Kelly, who police say shot seven people in an hours-long rampage Wednesday, killing four, has been charged in a 2020 shooting with three victims, according to court documents. He allegedly shot two people and nearly hit a third. Kelly eventually took a plea deal, admitted to only one count of felony aggravated assault, and was sentenced to three years in prison. However, he only served 11 months and walked free in March. Court documents obtained by Fox News Digital reveal he was initially charged with attempted first-degree murder in the shooting of Lamarcus Grandberry, a gang-related assault by Edward Rogers, with a firearm and the reckless endangerment of Rutrundra Gaston, who allegedly posed the last. “in immediate danger of death or serious bodily harm.” SURVEILLANCE VIDEO ARRESTED MEMPHIS LIVESTREAM MASSACRE AS EZEKIEL KELLY APPEARS IN COURT Ezekiel Kelly appears in Shelby County Court in Memphis, Tennessee on September 9, 2022. But Kelly eventually pleaded guilty to a reduced charge of aggravated assault. He was released from prison in March and, according to his aunt, was working as an aide at a nursing home before Wednesday’s mayhem. READ THE COMPLAINT: WHO IS EZEKIEL KELLY? ACCUSED MEMPHIS LIVESTREAM SCOOTER HAS VIOLENT CRIMINAL HISTORY The first victim Wednesday was identified by Memphis police as Dewayne Tunstall, who neighbors said was a childhood friend of the suspect. Kelly allegedly asked Tunstall to speak to him privately in a mutual friend’s driveway around 1am on Wednesday. (Matt Simons for Fox News Digital) After pushing Tunstall aside, Kelly allegedly opened fire in the middle of their conversation, hitting him at least once in the head, according to a police affidavit. Photos taken by Fox News Digital show bullet holes in the side of the house and a bloodstain on the asphalt. At least one shot came through a children’s bedroom window, with toys on the windowsill. (Matt Simmons for Fox News Digital) MEMPHIS SHOOTING: DUDE ACCUSED OF MURDERING 4, INJURING 3 IN RAMBAGE LIVE ON FACEBOOK Kelly’s rampage continued several hours later, with six more people shot, three fatally, and two in alleged carjackings. The mayhem ended around 9 p.m. after Kelly allegedly crashed a stolen car at the intersection of Ivan and Hodge streets. The police arrested him at the scene. He smiled into his mug. Kelly reportedly live-streamed portions of the attacks on Facebook, including the shooting of an unsuspecting shopper at an AutoZone store on Jackson Avenue. Judge Karen Massey asked him if he could afford a lawyer in his deposition Friday morning, and he said no, so she appointed a public defender. Ganguli did not immediately respond to a request for comment. The public defender, Jennifer Case, told the judge she intended to move for a gag order in the case. Kelly did not enter a plea and no bond was set during the hearing. Shelby County District Attorney Steve Mulroy said additional charges are likely against the defendant. Mulroy acknowledged the public is “concerned” and said the defendant will be held without bail due to the nature of the alleged crimes.
